Evicting Tenants – Document Checklist

In the unfortunate event a landlord requires to evict a tenant at any point these documents should be in order and to hand when considering this.

• Copy of all the tenancy agreements (all pages including the signed page) for your tenant whilst at this property or in the absence of a written agreement a breakdown of what the terms of the tenancy are (i.e. start date, original term, rent amount and frequency/date due)
• Copy of any notices/letters already served in relation to date you requested them to leave and any proof of postage if applicable / service if applicable
• Rent schedule (only if the tenant is in arrears and you wish to seek possession on rent arrears grounds; Section 8)
• Copy of the deposit protection certificate (if registered with the DPS the email sent confirming deposit details), the prescribed information pages and the scheme terms and conditions provided to the tenant after registration. Or if the deposit has been returned a copy of the documents confirming the deposit has been returned in full to the tenant.
• Copy of any licences required by the council such as for a House in Multiple Occupancy or selective licences if applicable
• Details of anything else which may be relevant such as disrepair issues, matters of breaches of tenancy, anti social behaviour, etc.
• Copy of paperwork for any failed/current court claims for possession/arrears or other matters relating to the tenant.
• Copy of the title register for the rental property address confirming you as the owner.
